By accessing or using Novablaze (The Fitness App), you agree to these Terms of Service (“Terms”) and our 'Privacy Policy' which is incorporated herein by reference. If you do not agree to these Terms, please do not use this App.
These Terms apply to all users of the app, and additional provisions may apply to specific jurisdictions (e.g., GDPR for EU users, CCPA for California residents).

1. Introduction

Novablaze is a Fitness Application designed to help you monitor and improve your health and fitness. Our services include real-time tracking of steps, calories, distance, pace, live GPS tracking, a vast library of exercise videos, customizable workout routines, task reminders, and a points system for rewards. Some features are available free of charge while others require a subscription.

2. Acceptance of Terms

By downloading, accessing, or using Novablaze, you agree to be bound by these Terms. Your continued use of the App signifies your acceptance of any modifications to these Terms as published in future updates.

3. Eligibility

To use Novablaze, you must:

• Be at least 13 years old. If you are under 18, you must have the consent of a parent or legal guardian to use the app.
• Create an account with accurate information, including your 'First Name', 'Last Name', and 'Email Address'.
• Agree to abide by these Terms and any applicable laws.

4. Description of Features & Services

Novablaze offers the following core functionalities:

• a. Activity Tracking
  - Step counting, distance tracking, calorie estimation, and pace monitoring.
  - GPS-based route tracking for visualizing your walking, jogging, or running paths. (This data is visible only to you unless you choose to share it).
• b. Exercise and Workout Content
  - Over 500+ exercise videos with proper directions.
  - Ability to customize your daily workout routine using the exercise content.
• c. Task Reminders
  - Set reminders for activities including drinking water, gym workouts or home exercises with weights, practicing yoga, stretching body, meditating mind, and maintaining a healthy sleep schedule.
• d. Feedback and Engagement Features
  • Feedback: Users can provide suggestions and comments.
  • Rating: Users can rate the app from 1 star to 5 stars (5 stars being the highest).
• e. Data Control
  You can delete individual activity records or your entire account at any time.
• f. Sharing and Deletion
  Users can share their activity data (e.g., GPS-tracked routes) or delete activities instantly.

5. User Obligations and Conduct

You agree to:

• Use Novablaze only for lawful purposes and in compliance with applicable laws.
• Not misuse the app, including attempting to manipulate points, interfere with others' use of the app, or reverse engineer the app’s functionality.
• Provide accurate information when creating your account and avoid impersonation or falsifying details.
• Maintain the confidentiality of your account and password.

We reserve the right to suspend or terminate accounts violating these 'Terms' without notice.

6. User Account Registration and Data Collection

6.1. Your data is collected, stored, and processed in accordance with our Privacy Policy. The data we collect includes:

• Account Data (Compulsory* Required): 'First Name', 'Last Name', 'Email Address'.
• Optional Data: Contact number, date of birth, gender, height, weight, and GPS location (if enabled).
• Fitness/Activity Data: Steps, calories, distance, pace, GPS routes, exercise video usage, and task reminders.
• Feedback Data: App ratings, feedback submissions, and app-sharing activity.

All collected data is secured and protected by the password you generate. Practices comply with GDPR and CCPA.

6.2. Data Retention and Deletion:

• Data is safeguarded using encryption and strict access controls.
• GPS data is visible only to you unless shared.
• Data backups prevent accidental loss.
• We retain data only as long as necessary. Upon account deletion, all data is permanently erased.

6.3. Account Responsibility

• You are responsible for your credentials.
• Do not share your password.

6.4. Third-Party Services

We may use third-party services for analytics, ads, and payments. These comply with strict data protection laws.

7. Subscription, Payment, and Refund Policy

7.1 Subscription: Monthly plan ₹99, billed every 30 days. Includes ad-free experience.

7.2 Payments are Non-Cancellable and Non-Refundable except under exceptional cases.

8. Intellectual Property

All app content, including designs, logos, text, and code, is owned by Novablaze. No reproduction or modification without consent.

9. Disclaimer of Warranties

Novablaze is provided “as is” with no guarantees. We do not warrant uninterrupted function or accuracy of fitness data. Use at your own risk.

10. Limitation of Liability

Novablaze is not liable for indirect, incidental, or consequential damages. Liability is limited to the amount paid for your subscription.

11. Modifications to the Terms

We may update Terms at any time. Notice will be provided in-app or via email. Continued use means acceptance.

12. Governing Law

These Terms are governed by Indian law. Disputes fall under Pune, Maharashtra jurisdiction.

13. User Rights

GDPR (EU Users): Access, modify, or delete data; restrict processing; complain to authority.
CCPA (California Users): Know data collected, request deletion, opt-out of selling (we don’t sell data).
